Terms & Conditions

1. Scope of Work

All services, deliverables, and project inclusions are outlined in the accompanying proposal, quotation, or invoice. Any additional work or revisions beyond the agreed scope will be billed separately at the prevailing hourly or project rate.

2. Payment Terms

Invoices are payable within 7 days of issue unless otherwise stated. Late payments may incur a late fee of 5% per month or the maximum permitted by law. Work may be paused if outstanding invoices remain unpaid.

3. Deposits & Commencement

A non-refundable deposit (where applicable) is required to begin work. The remaining balance is due upon milestone completion or final delivery, depending on the project structure.

4. Revisions & Amendments

Quoted fees include the number of revisions specified in the proposal or invoice. Additional revisions, change requests, or new features requested after approval will be billed separately.

5. Intellectual Property

Final approved deliverables become the client’s property once full payment is received. All preliminary work, drafts, unused concepts, working files, and design methodology remain the intellectual property of DesignsDusted unless otherwise agreed in writing.

6. Content & Materials Provided by Client

The client is responsible for supplying all required content, assets, and approvals in a timely manner. Delays in providing materials may extend project timelines.

7. Project Timeline & Delays

Timelines provided are estimates. DesignsDusted is not responsible for delays caused by late feedback, scope changes, third-party dependencies, or external factors beyond our control.

8. Cancellations

If a project is cancelled after work has commenced, the client is responsible for all costs incurred up to the cancellation date, including any non-refundable deposits.

9. Confidentiality

All client information, assets, and materials are treated as confidential. DesignsDusted may showcase completed work for portfolio and marketing purposes unless the client requests otherwise in writing.

10. Liability

DesignsDusted is not liable for indirect, incidental, or consequential damages arising from the use or inability to use delivered work, including performance issues tied to hosting, third-party integrations, or client-managed systems.

11. Final Approval

Approval of final deliverables signifies acceptance of the work as complete. Any issues identified after approval will be treated as new work and billed accordingly.

12. Hosting, Third-Party Services & External Costs

Any hosting, domain, storage, or third-party software costs are the responsibility of the client. DesignsDusted does not control third-party service performance or availability.

13. Amendments to Terms

These terms may be updated periodically. The version attached to the latest invoice or proposal applies to the project.
